Indonesia changes foreign land ownership rules
JAKARTA - A new regulation will permit a foreign resident to have a land use title for up to 10 hectares of non-agricultural land for residential use.
Hasan Basri Durin, the agrarian state minister and head of the National Land Office (BPN) said the restriction is also imposed on the size of land owned by individuals under land title for building construction (HGB).
He said the maximum sizes of land property for non-agricultural uses are arranged in a new regulation to be issued by the government. Under the new regulation land property by individuals for non-agricultural uses range in size from 5,000 sq.m. to two hectares depending on the density of an area.
Individuals are required to transfer to other people any excess of land they have from the limits set by the regulation. Failure to comply with the regulation in a year would mean land confiscation by the state.
''The land would be made an object of land reform,'' Hasan said, adding, ''certainly with some compensation."
Hasan said the draft regulation is still being studied and debated by related agencies.
He said the regulation is aimed at creating equity in land ownership and preventing land speculation.
